Terms of Use and Sale

These terms govern the use of the Inkluo extension. Part A (terms of use) applies to anyone using the extension. Part B (terms of sale) additionally applies to anyone subscribing to a paid plan.

The service is published by Moufid EL AROUI, a sole trader operating under the French micro-entreprise scheme, reachable at contact@inkluo.com. Full details are provided in the legal notice.

Part A — Terms of use

1. Purpose

Inkluo is a browser extension that assists with web accessibility auditing. It provides findings for information only and does not replace a compliance audit carried out by a professional. It gives no warranty as to the regulatory compliance of the pages analysed.

2. Account

Some features require an account. You are responsible for the accuracy of the information provided and for keeping your credentials confidential. Any activity carried out from your account is deemed to be performed by you.

3. Acceptable use

You agree to use the extension in accordance with applicable laws. The following are prohibited in particular: sharing or reselling an account, circumventing the limits of the free or trial plan, and any attempt to disrupt the service or misuse it.

4. Local page analysis

The audit runs entirely in your browser; no content from the analysed pages leaves the extension. The processing of your personal data is described in the privacy policy.

5. Intellectual property

The extension, its brand and its content remain the property of their owner. You are granted a personal, non-exclusive and non-transferable right of use, limited to the period of use provided for herein. No other assignment is granted.

6. Availability and changes

The service is provided “as is” and may evolve, be suspended or discontinued, in particular for maintenance or technical reasons. The publisher strives to ensure reasonable availability without any guarantee of uninterrupted continuity.

7. Liability

Accessibility findings are indicative. The publisher cannot be held liable for a decision made solely on the basis of these findings, nor for indirect damage. These terms do not limit the statutory guarantees you enjoy as a consumer.

Part B — Terms of sale (paid plan)

8. Offer and prices

Paid features are offered as a subscription. Prices, in euros, and the subscription period are shown at the time of purchase. Under Article 293 B of the French General Tax Code, the statement “VAT not applicable, art. 293 B of the CGI” applies: no VAT is charged.

9. Purchase and payment

Payment is processed by our provider Stripe; no card details are stored by Inkluo. By subscribing, you warrant that you are authorised to use the payment method provided. An invoice is issued for each billing period.

10. Term and renewal

The subscription is entered into for the period chosen at purchase. It is automatically renewed for an identical period, unless cancelled before the renewal date under the conditions of Article 12. You are informed of each renewal in accordance with applicable regulations.

11. Right of withdrawal

You generally have a period of fourteen (14) days to withdraw from an online purchase. However, since access to the digital service is provided immediately, at the time of purchase you request its immediate performance and expressly acknowledge that you waive your right of withdrawal once that performance begins, in accordance with Article L221-28 13° of the French Consumer Code. This consent is obtained at the time of payment.

12. Termination

You may cancel your subscription at any time from the extension. Cancellation takes effect at the end of the period already paid for: your access is maintained until that date, and no pro-rata refund of the current period is made. You may also delete your account at any time from the extension. The publisher may suspend or terminate an account in the event of a serious breach of these terms.

13. Consumer mediation

In accordance with Articles L611-1 et seq. of the French Consumer Code, if you are a consumer, you may use a consumer mediator free of charge to resolve a dispute amicably, after sending a written complaint to contact@inkluo.com. 14. Governing law and disputes

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first. Failing that, a consumer may bring the matter before the court of their place of residence; for other users, the courts having jurisdiction over the publisher’s registered place of business shall have jurisdiction.
